On June 26. 2023, our client was found not guilty in Lynn District Court in a jury-waived trial for operating under the influence. We opted to try the case in front of a judge instead of a jury because of the issues involved in the case.
Our client was charged with operating under the influence on route 1 in Saugus. Massachusetts State Police observed her driving, and their report said she was driving erratically, and failed field sobriety tests.
However, the State Police had dash cams and body cameras, and we were able to compare the camera footage with the officers’ testimony to show that they were shading the truth. Specifically, our client did not appear intoxicated and did well on the field sobriety tests according to the body and dash camera footage.
The judge agreed and found our client not guilty.
