If your license was suspended for refusing a breathalyzer, you can get your driver’s license back if you are found not guilty of OUI.  A breathalyzer refusal means a 180-day driver’s license suspension automatically, but that can be reduced if you resolve the underlying charge of operating under the influence.

This can mean rushing your OUI charge to trial as quickly as possible.  This can be difficult depending on the court you are going to.

How Long Will My Driver’s License be Suspended if I’m Charged with DUI?

Even a charge for operating under the influence can carry serious consequences for your driver’s license.  If you refuse a breathalyzer, your driver’s license will be suspended for 180 days (if you’re over 21).  If you fail a breathalyzer, your license would be suspended for thirty days.

Depending on the circumstances, your license can also be suspended indefinitely under the immediate threat statute.
