NOT GUILTY Verdict on Assault with Handgun Case in Fitchburg District Court

On April 27, 2023, we secured a NOT GUILTY verdict for a client charged with assault with a dangerous weapon (handgun) and vandalism in Fitchburg District Court.  Our client was charged with pulling out a firearm on someone during a road range incident and punching their vehicle.

We argued that our client never pulled out a firearm, or, if he did, it was done in self-defense.  This was based on the inconsistencies in the other party’s testimony as well as the difference in size and age between the two parties.  Additionally, the alleged victim did not leave the scene even though he was supposedly scared of the firearm, instead continuing to argue with our client while he was calling 911.

On the vandalism, we argued that our client could not have punched the truck to cause a dent without having significant injuries.  However, the police report did not show any injuries to our client, especially to his hands.

The jury agreed and found our client not guilty.  He had been facing these charges for almost three years and had been offered numerous deals by the prosecution but had declined them all.  His decision to go to jury trial paid off.
