DCF Fair Hearing Victory — Here's What That Means for You
A DCF neglect finding in Massachusetts can follow you for years — but it does not have to. A DCF fair hearing attorney can challenge that finding and, in the right case, get it reversed. If DCF has made a finding against you, that decision is not final. You have the right to fight back — and with the right representation, you can win. In this article, you’ll learn how we fight these cases and what a DCF fair hearing victory can look like.

What Is a DCF Fair Hearing in Massachusetts?

When the Massachusetts Department of Children and Families investigates a report of abuse or neglect and sustains a finding against you, that finding goes on your record. It can affect custody proceedings, family court matters, and other areas of your life for years.

What many people do not know is that Massachusetts law gives you the right to challenge a DCF finding through a formal process called a DCF fair hearing. At a DCF fair hearing, you can present evidence and arguments against the department’s decision. Critically, the hearing is conducted by a different DCF employee — one who had no involvement in the original investigation. That separation matters. It gives you a genuine opportunity to be heard by someone who is not already invested in the original outcome.

Massachusetts DCF fair hearings are not a formality. By some accounts, roughly half of DCF findings that go to a fair hearing are reversed. That number reflects something important: the original investigation does not always get it right.

A DCF Fair Hearing Victory: Our Client's Case

In the summer of 2025, Massachusetts DCF fair hearing attorney Matthew Peterson represented a father who had received a sustained finding of neglect from DCF. The finding stemmed from a mental health episode the father had experienced — an episode that led to a restraining order.

On the surface, DCF’s concern might sound reasonable. But the details told a different story.

Attorney Peterson raised two central arguments at the DCF fair hearing.

First, DCF did not conduct a thorough investigation. Investigators failed to speak with all relevant parties before reaching their conclusion. A DCF neglect finding built on an incomplete record is not a reliable finding.

Second, the incident did not constitute neglect under Massachusetts law. The mental health episode occurred entirely outside the presence of the children. Every party involved agreed on this point. It had never happened before, and it had never happened in front of the children. Most importantly, the father was already receiving appropriate mental health treatment. A diagnosis alone — especially one being actively and responsibly managed — cannot be the sole basis for a DCF neglect finding in Massachusetts.

The DCF hearing supervisor agreed. The finding was reversed.

Why a DCF Finding in Massachusetts Is So Serious

An adverse DCF finding in Massachusetts is not just a piece of paper. It can be used against you in probate and family court proceedings. It can influence decisions about your ability to parent your children. It can be accessed by third parties in ways that affect your employment, housing, and more. Having a DCF neglect finding removed from your record is a meaningful, concrete outcome — not just a legal technicality.

For this client, it meant the freedom to move forward without a DCF record following him.
