What is Larceny?

In Massachusetts, larceny is defined as the unlawful taking and carrying away of someone else’s property with the intent to permanently deprive the owner of its use or possession. This encompasses various forms, including larceny by stealing, false pretenses, embezzlement, and obtaining property by fraud. The law is codified under Massachusetts General Laws Chapter 266, Section 30.

What Are The Elements of Larceny?

To secure a conviction for larceny in Massachusetts, the prosecution must establish the following elements beyond a reasonable doubt:

  1. Unlawful Taking and Carrying Away: The defendant took and moved the property, even if only slightly or briefly.
  2. Property of Another: The property belonged to someone other than the defendant.
  3. Intent to Deprive Permanently: The defendant intended to permanently deprive the owner of the property.

These elements apply across various forms of larceny, including larceny from the person, larceny by false pretenses, and larceny by embezzlement.

What Are The Penalties Associated With This Crime?

Penalties for larceny in Massachusetts vary based on the value of the property stolen and the circumstances of the offense:

  • Property Valued Over $1,200: Considered felony larceny, punishable by up to 5 years in state prison or up to 2 years in jail and/or a fine up to $25,000.
  • Property Valued $1,200 or Less: Classified as misdemeanor larceny, punishable by up to 1 year in jail and/or a fine up to $1,500.
  • Larceny from a Person Aged 60 or Older or a Disabled Person: If the value exceeds $250, it’s punishable by up to 10 years in state prison or up to 2.5 years in jail and/or a fine up to $50,000.
  • Larceny in a Building: Regardless of the property’s value, this is a felony offense.
