What is a Non-Contested Divorce?

A non-contested divorce, also known as an uncontested or “1A” divorce in Massachusetts, is a mutual agreement between spouses to end their marriage amicably. This means both parties agree that the marriage has irretrievably broken down and have already reached a full settlement on all key issues—such as child custody, division of assets, child support, and alimony—before filing. Unlike a contested divorce, there is no litigation over disagreements, which typically makes the process faster, less expensive, and less emotionally draining.

What are the Grounds for Filing a Non-Contested Divorce?

In Massachusetts, the ground for a non-contested divorce is the “irretrievable breakdown of the marriage,” which is a no-fault basis. The couple files a Joint Petition for Divorce under General Laws c. 208, § 1A. There is no requirement to prove wrongdoing by either spouse. Instead, the focus is on demonstrating mutual agreement and cooperation in dissolving the marriage and addressing all related matters.

Why Do You Need to Hire an Attorney When Filing a Non-Contested Divorce?

While it’s legally permissible to file for an uncontested divorce without an attorney, having legal representation can be highly beneficial. Here’s why:

  • Ensuring Accurate Documentation: An attorney can help prepare and review all necessary documents, ensuring they meet court requirements and accurately reflect the agreement between spouses.
  • Navigating Complex Issues: Even in uncontested divorces, complexities can arise, especially concerning financial disclosures or child-related matters. An attorney can provide guidance to address these issues effectively.
  • Avoiding Delays: Proper legal assistance can help prevent common mistakes that might delay the divorce process.
  • Protecting Your Interests: An attorney ensures that your rights and interests are adequately protected throughout the process.
