What is Armed Assault with Intent to Rob?

In Massachusetts, if you are charged with the crime of armed assault with intent to rob, the Commonwealth is alleging that you assaulted and attempted to steal from another individual while in possession of a dangerous weapon. You may also be charged with armed assault with intent to rob if the Commonwealth believes that you were in possession of a firearm, shotgun, rifle, machine gun, or assault weapon while committing an assault on another individual.

Something to note, is that if the alleged assault victim is 60 years of age or older, the possible punishments if you are convicted are even more harsh than if the alleged victim is under that age.

If you are charged with armed assault to rob, you could be held on dangerousness pending trial as well.

What Does the Commonwealth Need to Prove?

For the prosecution to secure a conviction for armed assault with intent to rob, they must prove three things beyond a reasonable doubt:

  1. that the individual was armed with a dangerous weapon
  2. that the individual assaulted the victim
  3. and the individual had the intent to rob the victim

A key feature of this crime is the 3rd aspect of what the prosecution must prove, because they must provide evidence to prove that you intended to rob the alleged victim.

What are the Possible Penalties if I’m Convicted?

If you are convicted of assault while being armed with a dangerous weapon with intent to rob, you will be facing a sentence of no more than 20 years in state prison. If you are convicted of assault while in possession of a firearm, shotguns rifle, machine gun, or assault weapon, you will be facing a mandatory minimum sentence in state prison, with a maximum sentence of 20 years.

If the alleged victim is 60 years of age or older, and you are convicted of assault while being armed with a dangerous weapon with intent to rob, you face the same maximum sentence of no more than 20 years. If you are convicted of assault while in possession of a firearm, shotguns rifle, machine gun, or assault weapon, your mandatory minimum is raised to 10 years instead of 5 years.
