A jury in Boston Municipal Court, Central Division found our client NOT GUILTY of drug distribution. Our client was accused of distributing cocaine near the Park Street MBTA station in Boston.
Nearly the entire incident was captured on city cameras. The video showed our client talking to another party then descending a stairwell with them. After the other party appeared again, they were stopped and found with cocaine.
Our client was charged by the Drug Control Unit of the Boston Police Department. We argued that because they only dealt with drug cases, when they saw this incident, they assumed it was a drug deal. We told the jury “to a hammer, everything looks like a nail,” and there was not proof beyond a reasonable doubt that what happened was a drug deal.
The jury agreed, finding our client not guilty.
