Drug Charges DISMISSED in Woburn District Court

On August 10, 2023, Matthew W. Peterson secured a dismissal on charges of distribution of a controlled substance in Woburn District Court. This was based on how long the case had taken to prosecute — more than four years.

Our client was charged with distributing a controlled substance to undercover police officers. Police seized several hundred dollars from him.

We argued that because so much time had passed between the arraignment and trial date, our client’s speedy trial rights were violated. Massachusetts requires all criminal cases to be tried within a year, with a lot of exceptions.

We filed a motion to dismiss, and the judge agreed, dismissing the case. Not only that, but we got our client’s money back from him.
