A jury in Woburn District Court found our client NOT GUILTY of operating under the influence of alcohol and negligent operation of a motor vehicle. Our client was charged with driving a car in Burlington, Massachusetts, while being too intoxicated to drive.
Our client refused the breath test but performed field sobriety tests. Our defense was that he was not too intoxicated to drive. This was based on his performance on the field sobriety tests, as well as the booking video. The booking video showed that our client was acting normally.
We showed the jury the booking video and vigorously cross-examined both responding officers on our client’s intoxication.
The jury was out for less than half an hour before finding our client not guilty of OUI in Woburn District Court. We also filed a motion to reinstate our client’s driver’s license, which the judge allowed.
