Matthew Peterson Secures NOT GUILTY Verdict for MBTA Driver Charged with Negligence

On January 11, 2023, a jury in Boston Municipal Court, Brighton returned a NOT GUILTY verdict for our client.  Our client was charged with gross negligence as a common carrier for being the driver of an MBTA green line train that collided with another train.

Our client was operating a green line trolley on the B branch near Boston University on July 30, 2021.  His train rear-ended another green line trolley on the same track.

He was originally charged with a felony, but we filed a successful motion to dismiss that charge.  This left just a misdemeanor charge for trial.

Our defense was based on this being nothing more than an accident.  There was evidence that our client was unconscious at the time – he told police initially he did not remember what happened, and we called a passenger on the train who said he was not responsive after the crash.

News cameras covered the entire trial from within the courtroom, filing everything from the opening statement to closing argument.  The jury agreed that “sometimes an accident is just an accident, and our client was acquitted.
