On October 2, 2021, the Law Office of Matthew W. Peterson achieved a significant victory by getting drug evidence (class a substance) against a client excluded from court proceedings. This ultimately led to the dismissal of the case in Chelsea District Court.
The client was charged with possession of a Class A substance after being stopped based on an anonymous tip suggesting that a fanny pack he carried contained a firearm. During the stop, law enforcement conducted a search of the client’s backpack and discovered a controlled substance concealed within a sunglasses case.
In response to the unlawful search, our legal team promptly filed a motion to suppress the evidence, arguing that it was obtained in violation of the client’s rights. Following a thorough hearing, the judge in Chelsea District Court agreed with our argument, ruling that the drugs were seized illegally and ordering their suppression. This critical decision meant that the prosecution could not present this evidence at trial.
As a result of this ruling, all charges against our client were dismissed, allowing him to move forward without the burden of these allegations.
