Jury Finds Client NOT GUILTY of OUI and Negligent Operation in Chelsea

On November 1, 2023, the Law Office of Matthew W. Peterson went to a jury trial on a charge of operating under the influence and negligent operation in Chelsea District Court.

Our client was stopped by Chelsea Police after being seen fleeing an accident scene with his hazard lights on.  After police turned their lights and sirens on, our client took about a minute to stop for police.  It took police pulling in front of him and stopping before our client stopped.

Our client said he could not do the field sobriety tests and was seen being unsteady on his feet.

We argued that there was no evidence that our client’s operation of a motor vehicle was impaired.  He drove normally when police observed him.  Additionally, we argued that our client’s behavior after being arrested — including entering and exiting the car, and during booking, indicated that he was not under the influence.

Furthermore, there was no physical evidence of his intoxication, including no video.

After a one-day jury trial, the jury agreed and found our client not guilty of both operating under the influence (OUI) and negligent operation.
