Client Found NOT GUILTY for OUI in Chelsea District Court

A jury in Chelsea District Court found our client NOT GUILTY of operating under the influence on January 19, 2023.  Our client was charged with operating under the influence after Chelsea Police found him unconscious in his car in downtown Chelsea.

No evidence of sobriety tests or breathalyzers were introduced, because our client refused to do both tests.  The Commonwealth could not introduce evidence that he refused the tests.

We argued that there was insufficient evidence to support that our client operated the vehicle under the influence.  This was based on the fact that the car was parked normally, there was no evidence he did not drive safely, and the evidence that he admitted drinking was not enough.

The jury agreed, finding our client not guilty of OUI.
